The food processor’s purchaser put the processor into bankruptcy and the bankruptcy trustee tried to stop payment to farmers. After considerable motion work, the firm obtained a very favorable confidential settlement payment for our farm clients from the food processor’s owners.

Agrifrozen Foods (Birdseye) Bankruptcy

United States Bankruptcy Court

The firm successfully represented 180 farmers in fraud and claims to seek payment for crops delivered to a food processor. Notwithstanding considerable motion practice in both New York and Oregon, the case was set for trial. After more than four days of mediation, this firm negotiated a significant confidential settlement in favor of the farmers.

Sunwest SEC Receivership

United States District Court

The firm represented more than 400 investors in what was determined by the court to be one of the largest Ponzi schemes in the state of Oregon. The firm’s representation included successful attempts to trace investments and find work-out solutions with lenders and other creditors, provide input into the receiver’s plan to distribute the company’s assets, and present claims for repayment on behalf of several hundred investors.
